| I just finished a case today where my client was caught driving a car containing 43 pounds of marijuana. He pleaded guilty to importing in excess of 5 kilograms of marijuana into Maryland, for which he received a sentence of....9 months in county jail, with a recommendation that he participate in the jail's work release program (which would permit him to work outside the jail, and only come back to the jail to sleepover until the next morning,before returning to work). The maximum penalty allowed under Maryland law for this offense is 10 years in state prison. I was able to get the sentencing judge to agree to 9 months in the county jail due to my client's lack of prior record, as well as the fact that there were legitimate issues in the case as to whether legal grounds existed to stop my client in the first place, and to continue to detain him beyond the time that the original basis of the stop (for following another vehicle too closely) should have been completed by (in other words, was there a basis to detain my client beyond the time that a traffic warning citation was, or should have, been issued. | Topics
