I just recently finished a jury trial in a case where my client was charged with attempted murder, following the non-fatal shooting of the victim. The victim did not identify who shot him, but an eyewitness claimed my client was the shooter. Actually, the eyewitness, the first time he spoke with the police, shortly after the shooting, claimed not to know who the shooter was. However, about two weeks later, the eyewitness identified my client as the shooter. A significant part of the defense was that the eyewitness only named my client as the shooter after he became fearful that he was going to be charged by the police. The jury returned not guilty verdicts as to both attempted first and second-degree murder. The jury was hung (that is, could not reach a unanimous verdict) and several lesser charges, so those will be reset for a later date. But, the two most serious charges did result in not guilty verdicts. This was the 6th straight not guilty verdict I have received in a murder, or attempted murder, jury trial.
