Big Win in Maryland's Highest Court

Just recently, the Maryland Court of Appeals, the highest court in the state, reversed the conviction of a client of mine, on the grounds that the evidence at trial was insufficient to support a guilty finding.  The client was charged with robbery, which requires the forcible taking of the property of another by violence, or threat of violence.  The only evidence the state produced at trial on the issue of violence was that my client approached a cashier at a Jiffy Lube and stated, "don't say nothing," after which the cashier handed my client the cash drawer.  There was no evidence my client had any type of weapon on him at the time of the incident.  I argued that, under these facts, a theft had occurred,but that the state had failed to prove the crime of robbery.  The trial judge disagreed, found my client guilty, and sentenced him to 25 years imprisonment, without parole.  The case was taken up on appeal, and the Court of Appeals has just reversed my client's conviction, in so doing agreeing with my argument that the evidence was insufficient to prove that a robbery (as opposed to a mere theft) took place.
